Cxxx and I have been looking forward to 2009 for many months. If you recall at the beginning of 2008, I had a terrible start to the year and lost all of my trading capital. I had such a good year the year before I thought I had it figured out….obviously not. So now I’m hoping that I can get some capital back via tax refunds and NOLs and we are very excited about the chance of that happening. I appreciate VERY MUCH all that you do and have no problem waiting for the tax organizer. I am really looking forward to this year as a year of building back our capital and then more intelligently earning on it going forward. This is the second time in the last few years that I have had a really bad year. I don’t intend for there to be a third time and we will adjust our risk taking accordingly in future trading activity.

I do have one question though. I’m worried that the tax laws may change later this year due to the Obama administration and the large government deficits. I’m wondering if the trade off of waiting on filing returns (via an extension) to minimize the risk of audits is worth the risk that either state or federal tax laws get changed to eliminate NOL carry backs.

Should I try and help you get my returns filed asap to reduce the risk of an adverse tax law change for my situation or does it make more sense to go the extension route like in previous years? I know there may not be an easy answer but I was wondering what your (and/or Jaren’s) views are on this for the 2008 returns.

"My experiences with GreenTraderTax have been excellent, fast, and
professional. They are the most knowledgeable and efficient firm in this
area. GreenTraderTax has helped me get out of negative situations with the
IRS caused by using recommendations made by a competing firm in Florida.
The author of a book called "The Trader's Tax Solution" (written in 2000)
recommended to set up a LLP and C-Corporation in Nevada (not my home state).
It cost a few thousand dollars to set up the entities, but then they
wouldn't provide instructions on how to operate the entities correctly and
legally.

As a starting trader this business setup was very complicated. The Florida
firm charged me $200/hour to explain how to operate the entities. They
would not provide anything in writing. I agreed to the $200/hour consulting
fees, but requested to have my CPA on the phone during the session. The
author of the "The Trader's Tax Solution" demanded $350/hour consulting fees.
I refused to pay the $350/hour to have my CPA present, because I felt they cornered me, were
taking advantage of me and trying to extort money from me because they had
me in a bind. Their behavior was not only unprofessional, but they gave me
bad advice that was wrong. And then they were unwilling to help me without
paying thousands of dollars more. Their behavior bordered on negligent and
criminal.

It took me threee years working with GreenTraderTax to untangle the mess
made by . I still have $30,000 in losses tied up in the Nevada
C-Corporation that I have no legal way to take on my personal return.
GreenTraderTax has helped me recover many of my trading losses, has made
the entire trading business much simpler for me, and helped me get past due
refunds from the IRS. They have worked on tight deadlines and don't charge
exorbitant fees. They explain things very clearly and are a joy to deal
with. Stick with GreenTraderTax if you want to learn how to set up and
operate a trading business properly.

Stay away from other firms, especially the author of "The New Trader's Tax
Solution." These other firms can be scammers that offer complex solutions
that are very costly and frequently outright WRONG.

They are not knowledge professionals like GreenTraderTax."

Members of your firm made several reviews of the returns before they were mailed to me over last weekend. Your overnight package contained specific instructions for each of the three filings, together with addressed envelopes in which I shall mail each item today.

By the way, during Deborah’s review of my prior returns she found an item that I missed in an earlier return that will save me an additional ~$1,500 when she prepares the amended return.

Two years ago your green trader tax guides saved my bacon: the IRS hit me with a full-scale, 3 year line item audit challenging my trader tax status. They claimed that I owed them over $250,000. My (then) accountant was doing an excellent job of organizing my records, but defending the mark-to-market trader status was beyond his area of expertise. The information from your guides was critical to my defense -- the IRS eventually ruled in my favor. Best trade of the year. Since then I've relied on you for all my accounting.

That was a complicated year for me since I had declared trader tax status in my 1998 filing, so the auditor would be questioning how I qualified according to the applicable, complicated set of rules. I also had significant medical deductions in that time period and they were used to offset an IRA withdrawal. When I first received notice of the audit, I was very upset since I had undergone a total audit just 2 years ago. When I started preparing for it, I felt quite overwhelmed on how to handle the trader portion. I knew that I could be charged with additional taxes and penalties, not only if I were incorrect, but also if I couldn't totally defend my deductions because I didn't have the knowledge of the trading rules. So, even though your office handled my taxes that year and I was convinced that they were a correct representation of my income and deductions, I knew that I could still end up paying taxes if I didn't have the capability of explaining the tax status and the deductions correctly. When I decided to turn over the audit to you, I felt such a breath of relief. Your office handled it efficiently and you minimized the work that I was responsible for. By having such an in-depth knowledge of the tax code as it relates to trading, you were able to deal with the auditor and confirm that I both met the qualifications for trader status and filed correctly. I just received notice of "no change", meaning that the audit is over and I owe nothing additional. Thank you for your work on my behalf.

I heard him speak candidly and at length at the Nasser booth, and it turns out that he was informative and generous with his time. He's got the hardcore New York, no-bullsh*t attitude and claimed that the speaker from a competing trading firm (who had a presentaion on the stage-floor and I can't remember the name of the company) was WRONG on several tax issues.

He claimed to correct the competitors' allegations on his website, within a few weeks. He was the last speaker at the marketwise school booth at the expo, and Nasser had to cut his talk short, since everyone was asked to leave the convention floor after 5PM. It was a bummer, because he had lots to say and wasn't even given a working microphone from which to speak. But he didn't care...he was screaming from the bottom of his diaphram so that everyone in the back would hear his message. It was interesting to watch him....he said that the other trading tax venues would have their traders audited with their suggestions of claiming income on Schedule C from their short-term traders (or something along those lines. Please don't quote me).

So, what happened is that instead of finishing and packing his stuff to go home after Nasser abruptly ended him...he resumed his talk for another 20 minutes on stage-right...until security kicked all of us out of the convention floor.

I would go with him. I think he did the accounting for the Datek folks, since he demonstrated something on his website that had their name on it. He mentioned that instead of Datek button being there, it would have the Nasser's name on it.

I'm confident that if David Nasser's company is working with him...he's gotta be the best out there.

The thing I liked best about his services, is that he will take your calls for FREE, if you have any questions. So, even though, he's not someone you can see tet-a-tet, I would take advantage of the free consultation phone call. It's better than having a local accountant, fail to mark-to-market your account for tax purposes. Don't know that M-t-M is, yet? Well, that's something I learned from Green.

I will use him, whenever I begin to trade.
